By purchasing or using our services, you agree to these Terms including the mandatory arbitration agreement in Section 6.
These Terms of Service constitute a legally binding agreement between you and Touchpoints Healthcare Security, operated by Christopher Reaves, regarding your use of our external security assessment services.
THS provides automated external security assessments analyzing publicly accessible systems for potential security vulnerabilities.
Pricing:
What We Do NOT Provide: Internal network testing, complete HIPAA SRA, legal advice, implementation services.
Our external security assessments scan ONLY publicly accessible systems. This does NOT constitute a complete HIPAA Security Risk Assessment.
Payment required in full before scan initiation. Subscriptions renew automatically unless canceled. Refunds available only if scan not yet initiated.
THIS ASSESSMENT IS FOR INFORMATIONAL PURPOSES ONLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID. WE ARE NOT LIABLE FOR: IMPLEMENTATION ERRORS, BUSINESS INTERRUPTIONS, DATA LOSS, REGULATORY FINES.
IMPORTANT: You and THS agree that disputes shall be resolved through binding arbitration rather than in court, except for small claims court actions.
Class Action Waiver: Claims may only be brought individually, not as part of any class action.
Opt-Out: You have 30 days to opt out by emailing chris@securetouchpoints.com with subject "Arbitration Opt-Out".
You agree to indemnify THS from claims arising from: your implementation of recommendations, your provision of false information, your unauthorized use, or your violation of laws.
Auto-Renewal: Subscriptions renew automatically. We'll send reminder 7 days before renewal.
Cancellation: Cancel anytime via email. Effective at end of current period. No refunds for partial periods.
